Peipert vs Hoffman La-Roch

3/24/10 – Edwardsville, IL – Accutane lawyers representing a man who developed Inflammatory Bowel Disease after taking the acne drug have settled a case that had been litigated for approximately seven years.  The case was set to be the first Accutane lawsuit in the country to go to trial after years of continuances and delays.

Jason Peipert filed the lawsuit against the makers of Accutane, Roche Laboratories Inc. and Hoffman-LaRoche Inc., in 2003, alleging that he developed Inflamatory Bowel Disease after taking the drug in the late 1990s. Roche vigorously defended the claim, and has admitted no fault despite the settlement.

The popular acne drug, which was on the market from 1982 until 2009, was taken by an estimated 13 million people.  Experts have now related Accutane to Inflammatory Bowel Disease, Ulcerative Colitis and Crohn’s Disease.

This marked the oldest Accutane lawsuit on record.  Since then, more than 1,000 lawsuits have been filed by people alleging the drug caused them serious side effects.

The lawsuit was originally set for trial in 2007, but was delayed by each party several times.  At a pre-trail conference earlier this year, the parties were urged by the judge to attempt a settlement prior to the April 12 start date.

According to filings with the Madison County Court, the terms of the settlement are confidential and each party will bear their own costs for the litigation to date. Peipert has also filed a medical malpractice claim against his physician for the injuries he sustained.  That case remains open.

Accutane attorneys representing those injured by the drug expect future cases will proceed to trial instead of ending in settlement, as juries appear willing to compensate those injured by the drug for their suffering.
